Terms of Service

1. Introduction

Welcome to Pixzlo! These Terms of Service ("Terms") govern your access to and use of the Pixzlo Chrome extension, web application (app.pixzlo.com), and associated services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Eligibility and Account Registration

To use the Service, you must be of legal age to form a binding contract in your jurisdiction. You may be required to create an account and provide accurate and complete information. You are responsible for maintaining the security of your account and all activities that occur under it. You agree to notify Pixzlo immediately of any unauthorized use of your account.

Currently, you can sign in using your Google account. By doing so, you authorize Pixzlo to access certain information from your Google account in accordance with our Privacy Policy.

3. Use of the Service

Pixzlo is a design/UI QA tool that allows users to select elements, compare them to Figma elements, and report issues. The Service is intended for your internal use to facilitate UI bug reporting and design quality assurance.

You agree to:

• Use the Service only for its intended purpose.
• Comply with all applicable laws and regulations.
• Provide accurate and lawful information.

You may not:

• Use the Service for any illegal or unauthorized purpose.
• Attempt to reverse-engineer, modify, or interfere with the Service.
• Upload or share any content that is harmful, offensive, or infringes on others' rights.
• Engage in any activity that interferes with or disrupts the Service.

Violation of these terms may result in the suspension or termination of your access to the Service.

4. User Content

Users can create and upload content through the Service, including screenshots, annotations, and bug reports ("User Content"). You retain all ownership rights to your User Content. You are solely responsible for your User Content and represent that you have all necessary rights to upload and use it in connection with the Service.

By submitting User Content, you grant Pixzlo a worldwide, non-exclusive, royalty-free, fully paid, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content solely for the purpose of operating and providing the Service to you and your authorized team members. This includes facilitating integrations with third-party services like Figma and Linear.

Pixzlo does not collect any User Content without your explicit action (e.g., taking a screenshot, submitting a report). We do not claim any ownership over your User Content.

5. Intellectual Property

All intellectual property rights in the Service, including its software, design, trademarks, and content (excluding User Content), are owned by Pixzlo or its licensors. You are granted a limited, non-exclusive, non-transferable, and revocable license to use the Service for its intended purpose, subject to these Terms. You may not copy, modify, distribute, sell, or lease any part of our Service without our prior written consent.

6. Service Availability and Modifications

Pixzlo strives to provide a reliable service, but we do not guarantee uninterrupted or error-free operation. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We may also introduce new features or impose limits on certain features. We will endeavor to provide reasonable notice of any material changes that may adversely affect you.

7. Paid Services and Billing

Currently, Pixzlo is offered for free. However, we plan to introduce paid plans in the future, which may include monthly and annual billing options. Any payment terms presented to you at the time of purchase will be considered part of these Terms. We reserve the right to change our pricing and billing methods at any time. Details regarding refunds will be provided with the introduction of paid plans.

8. Third-Party Integrations

Pixzlo integrates with third-party services such as Figma and Linear. We may integrate with other services (e.g., Jira, Trello, Slack, GitHub) in the future. Your use of these third-party services is subject to their respective terms and conditions and privacy policies. Pixzlo is not responsible for the practices or policies of any third-party services.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. We are not currently GDPR compliant, but we are working towards compliance as we expand our services to EU/UK customers. We collect your first name, last name, email, and screenshots you choose to share. We may use analytics tools like PostHog for tracking, but we do not collect data without user action.

10. Termination

You may stop using the Service at any time by contacting us at hi@pixzlo.com. Pixzlo reserves the right to suspend or terminate your access to the Service or your account at our sole discretion, with or without notice, for any reason, including but not limited to your breach of these Terms, fraudulent, abusive, or harmful behavior. Upon termination, your right to use the Service will immediately cease. Provisions that, by their nature, should survive termination, will survive.

You agree to indemnify and hold harmless Pixzlo, its affiliates, directors, employees, and licensors from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with (i) your access to or use of the Service; (ii) your violation of these Terms; or (iii) your User Content.

14. Governing Law and Arbitration

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any dispute arising from or relating to the subject matter of these Terms shall be settled by binding arbitration in the United States, in accordance with the rules of the American Arbitration Association. Judgment on the arbitration award may be entered in any court having jurisdiction thereof. You agree that any arbitration shall be conducted in your individual capacity and not as a class action or other representative action.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
